Terms Summary
By accepting a quotation, paying a deposit, submitting an online order, arranging delivery, collecting goods or purchasing from Premium Plant Pots Pty Ltd, the Client acknowledges and agrees to be bound by these Terms and Conditions.
Terms accepted on order
By accepting a quotation, paying a deposit, submitting checkout or placing an order, the client accepts these terms.
Quotes valid for 7 days
Quoted prices may change after 7 days because of material costs, availability, supplier changes or other external factors.
Natural product variation
Concrete, stone, plants and natural materials may vary in colour, texture, tone, size and finish.
Payment must reflect
Orders, bookings, delivery dates and production slots are only confirmed once payment has cleared.
- All quotations, invoices, checkout submissions and order confirmations are subject to these Terms and Conditions unless otherwise agreed in writing by Premium Plant Pots Pty Ltd.
- All quoted prices are valid for 7 days from date of issue. After this period, pricing may change without prior notice because of product availability, supplier changes, material costs or other external factors.
- Premium Plant Pots Pty Ltd is committed to customer satisfaction. If you are dissatisfied with any product or service, please contact us at sales@premiumplantpots.com .
- No product supplied by Premium Plant Pots Pty Ltd, including plants, compost, fertiliser, topsoil, lawn dressing, concrete products or related goods, is suitable for human or animal consumption.
Section 2
Definitions
In these Terms and Conditions, the following words have the meanings below unless the context clearly requires otherwise.
Client
The person, company or entity purchasing goods or services and responsible for payment unless otherwise agreed in writing.
Company
Premium Plant Pots, including its authorised staff, representatives, delivery teams and service providers.
Goods
Concrete pots, planters, troughs, plants, soil, compost, bark, stone, hard-landscaping materials and related products supplied.
Services
Delivery, collection assistance, installation, planting, landscaping, offloading and related services performed or arranged by the Company.
Contract
The agreement incorporating the quotation, checkout order, invoice, approved scope of work and these Terms and Conditions.

Section 4
Orders & Payment Terms
- Orders are prepared for delivery, collection, production or installation only once payment has been received and cleared in Premium Plant Pots Pty Ltd’s bank account.
- Where a scheduled date is requested, payment must reflect at least 24 hours before that date unless otherwise agreed in writing.
- Booking dates, production slots, product reservations and delivery dates are not guaranteed until payment reflects and the order is approved.
- Proof of payment alone does not confirm payment. Orders are processed only once funds have cleared and have been verified.
- Premium Plant Pots Pty Ltd may refuse, cancel, substitute or refund an order where products are unavailable, pricing has changed, payment has not reflected or the order cannot reasonably be fulfilled.
Section 5
Cancellation Policy
Cancellation requests must be provided in writing to sales@premiumplantpots.com . A cancellation is only valid once confirmed in writing by Premium Plant Pots Pty Ltd.
Written cancellation required
Cancellation requests must be sent in writing to the Company and are only valid once confirmed in writing.
Concrete pots and hard-landscaping products
A minimum of 7 days’ written notice is required for a full refund where production, preparation, loading or dispatch has not started.
Custom-made or production-started items
No cancellation is permitted once custom-made products, plant pots or hard-landscaping items have entered production.
Cancellation after dispatch
If an order is cancelled after the truck has departed, the client remains liable for the full delivery fee.
Important: Orders that have entered production, dispatch, loading, delivery or installation may not qualify for cancellation or refund.
Section 6
Refund Policies
- Premium Plant Pots Pty Ltd reserves the right to refund payment if ordered goods are unavailable.
- If goods are unavailable, Premium Plant Pots Pty Ltd may offer a suitable substitute. Any approved price difference may be refunded, credited or charged before the order is completed.
- Refunds are subject to product eligibility, inspection, order status, payment verification and management approval.
- Delivery fees, transport costs, return shipping, packaging, palletising, wrapping and administrative costs are non-refundable unless otherwise agreed in writing or required by law.
- Refunds will only be processed once payment has fully reflected in the Company’s bank account.
Refund eligibility conditions

✓The item must be in its original packaging where applicable.
✓The item must be in a saleable condition.
✓The item must be returned within 72 hours of purchase where eligible.
✓The item must be accompanied by proof of purchase.
✓Return transport or shipping costs are for the client’s account unless agreed otherwise in writing.
Section 7
Delivery & Collection
Delivery requirements and responsibility
- The Client must notify Premium Plant Pots Pty Ltd in writing before placing an order of any access issues, including narrow roads, estate restrictions, weight limits, security procedures, difficult terrain, steep driveways or height restrictions.
- If undisclosed access limitations are discovered after an order is placed, Premium Plant Pots Pty Ltd may reschedule, use an alternative delivery method or charge additional transport, labour, redelivery or vehicle costs to the Client.
- Deliveries may be performed using 4-to-8-ton trucks. If the Client asks the driver to move further onto private or third-party property, this is done entirely at the Client’s risk.
- Premium Plant Pots Pty Ltd will not be liable for damage to driveways, paving, kerbs, irrigation, lawns, underground services, property or access routes caused by customer instructions, unsuitable access or site conditions.
- Materials are offloaded next to the truck at the nearest safe access point. The Client must arrange labour to move goods to the final position.
Estimated delivery times
- Delivery times are estimates. Premium Plant Pots Pty Ltd reserves an allowance of up to 72 hours from the agreed delivery date to complete delivery.
- Premium Plant Pots Pty Ltd is not liable for expenses, inconvenience, contractor standing time or consequential losses caused by delays outside its reasonable control.
- If delivery cannot be completed within 72 hours, the Company will contact the Client to arrange an alternative delivery date.
- Installers, gardeners or contractors should preferably be scheduled for the day after delivery to reduce risk caused by delivery delays.
Delivery acceptance and inspection
- The Client or an authorised representative aged 18 years or older must be present to receive, inspect and sign for goods.
- The Client must immediately check product condition and quantity upon delivery.
- Any shortage, visible damage or dissatisfaction must be reported before the driver leaves by contacting 010 213 4790 or sales@premiumplantpots.com.
- Failure to report shortages or visible damage before departure constitutes acceptance of the goods in good order.
Collection policy
- Premium Plant Pots Pty Ltd does not arrange packaging or courier services for third-party couriers unless agreed in writing.
- If the Client uses a third-party courier, all responsibility for collection, packaging, transport and delivery lies with the Client and courier.
- Prices exclude wrapping materials, pallets and additional packaging unless otherwise stated. Wrapping or palletising will be charged separately.
- If collecting hard-landscaping products or heavy concrete pots, the Client must ensure the collection vehicle is suitable. A truck, forklift or grabber may be required for safe loading.
- Risk transfers to the Client once goods are collected from the premises by the Client or the Client’s designated carrier.
Section 8
Installation Guarantees
Premium Plant Pots Pty Ltd offers limited guarantees on installation services from the date of completion, subject to proper client maintenance and the exclusions below.
Paving Installation Guarantee
Guarantee period: 12 months
Covers
- Structural stability
- Proper levelling
- Jointing workmanship
Excludes
- Heavy vehicle damage unless specified in writing
- Ground movement or soil subsidence not caused by the Company
- Drainage changes made after installation
- Misuse, overloading or alterations by the client
Planting Installation Guarantee
Guarantee period: 14 days
Covers
- Correct horticultural planting practices
- Reasonable workmanship during planting
Excludes
- Under-watering or over-watering
- Neglect, pests or disease
- Extreme weather or transplant shock
- Relocation or disturbance of planted material
Section 9
Client Maintenance & Site Responsibilities
- All guarantees are void if the Client fails to follow watering, maintenance, care or usage instructions.
- Guarantees are void if installed elements are moved, altered, disturbed, overloaded or damaged by the Client, third parties, pets, vehicles or environmental factors.
- The Client must report issues within the applicable guarantee period.
- Quotes are based on visible site conditions. Premium Plant Pots Pty Ltd is not responsible for unforeseen subsurface conditions, including buried utilities, rocks, roots, unsuitable soil or hidden obstructions.
- The Client is responsible for securing pets, children, valuables and access areas during delivery or installation.
- The Client must disclose underground utilities, irrigation, cables, pipes, obstructions or site risks before work begins.
Section 10
Liability Disclaimer
- Premium Plant Pots Pty Ltd and its employees shall not be liable for direct, indirect, incidental or consequential damages, including property damage, loss of use, personal injury or financial loss, except in cases of proven gross negligence or wilful misconduct.
- Any private arrangement between the Client and a delivery or installation team outside the Client’s agreement with Premium Plant Pots Pty Ltd is strictly between those parties. Premium Plant Pots Pty Ltd is not liable for claims, damages or losses arising from such private arrangements.
- Where third-party products or services are supplied, installed or recommended, manufacturer warranties apply. Premium Plant Pots Pty Ltd accepts no liability for third-party failures.
- Premium Plant Pots Pty Ltd is not liable for damage caused by drought, frost, floods, excessive rain, hail, extreme temperatures, environmental stress, pests, disease or other natural events.
- Clients and the public must not interfere with or operate machinery, tools, materials or equipment on site. Premium Plant Pots Pty Ltd accepts no liability for accidents caused by unauthorised access or interference.
- To the fullest extent permitted by law, the maximum liability of Premium Plant Pots Pty Ltd is limited to the total value of the applicable contract or service agreement.
